As late as 2007, the Byng family still sought a postumous pardon and the Ministry of Defense still refused.

I suspect the reason why the Ministry won't budge centuries later is that they're afraid of a law suit for long term damages, because otherwise, given the temporal distance and the fact no one currently in government can be embarassed by blaming a couple of Georgian politicians for scapegoating Byng, this would be a cheap gesture to make...
